Conditions

Location: The cottage is located at 54399 Big Hawk Lake Road, Algonquin Highlands, Ontario, Canada (“Cottage Property”). It is an Island property.
Checkin: The Cottager shall check-in after 3:00 PM on the Arrival Date and check-out by 11:00 AM on the Departure Date.
Bookings: shall be confirmed in writing/email by the Cottage Owner on receipt of a signed contract with a booking deposit of 50% of total contribution. The booking deposit will be applied toward the total amount collected. The amount contributed shall be paid in full in Canadian funds on or before 30 days prior to arrival.
Security/damage - $0 waved
Garbage: Upon departure, please take your garbage with you. You can drop it at the dump on the way home or take the garbage home with you.
Contributions: All contributions shall be made by money order, or electronic funds transfer. Preferred email transfer to daiv.mowbray@gmail.com.
Cancellation Owner: In the highly unlikely event that the Cottage Owner cancels the reservation due to fire, act of god, etc…. all contributions made by the Cottager will be returned to the Cottager by the Cottage Owner without interest or deduction within two (2) weeks of the cancellation. No further compensation shall be paid by the Cottage Owner to the Cottager.
Cancellation Tenant: Cancellation by the Cottager shall be in writing/email and addressed to the Cottage Owner. On receipt of such notice of cancellation, the Cottage Owner will endeavour to re-book the Cottage Property for the entire term of the original booking. If the Cottage Owner is successful in re-booking the Cottage Property for the entire period originally booked the Cottage Owner shall refund the Cottager all monies paid (whether by deposit or otherwise) less a cancellation fee of $300.00. If the cancellation is more than 60 days before rental period, the cancellation fee is waived. After the 60 day prior period, if the Cottage Owner only succeeds in re-booking the Cottage Property for a portion of the period originally booked, the Cottage Owner shall refund the monies paid relating to the period re-booked, less a cancellation fee of $300.00. If the Cottage Owner is unable to re-book the Cottage Property at all then all monies paid by the Cottage Renter (whether by deposit or otherwise) shall be forfeited to the Cottage Owner. The Cottager shall not be refunded for a late arrival or early departure. Requests by the Cottager for alternative dates will be processed only if the original booking can be re-booked.
Guests: Along with the Cottage Renter, the people listed in your group are allowed to use the Cottage Property. No other guests shall be permitted at the Cottage Property without the Cottage Owner’s written permission. Should the Cottager contravene the maximum number of guests permitted at the Cottage Property as stated herein the Cottager will be subject to immediate eviction without refund or an additional nightly charge of $200.00 per person at the discretion of the Cottage Owner.
There shall be no subletting of the Cottage Property permitted.
Pets: The following pets are allowed on the premises: Maximum of 2 dogs or cats. The Cottager is/are responsible for the good behaviour of their pets and the clean up after their pets. The Cottager acknowledges that the Cottage Owner accepts no liability for any pets or their actions.
Property: The Cottager shall keep the Cottage Property and all furniture, fixtures, chattels, fittings and effects at the Cottage Property, in the same state of repair and condition as at the commencement of the term and shall leave the Cottage Property in the same state of cleanliness and general order in which it was found. If the premises appear dirty upon check-in, renter shall inform owner immediately. On departure, the Cottager shall remove all food products from the fridge/freezer/cupboards/pantries and shall remove them from the Cottage Property. Failure to do so, to the satisfaction of the Cottage Owner may result in a damage/cleaning charge being levied. The Cottager shall not rearrange the furniture or fixtures at the Cottage Property.
Repairs: The Cottager shall not attempt repairs and should contact the Cottage Owner as soon as possible to make any emergency repairs.
Smoking: is not permitted in the building(s) located at the Cottage Property.
Insurance: The Cottage Owner reserves the right to request proof of a home/contents insurance of the Cottager to demonstrate that any damage made at or to the Cottage Property shall be covered by the Cottager’s home/contents insurance. Please provide policy number and insurance company name, of your policy.
Usage: The Cottager represents, warrants, acknowledges and agrees with the Cottage Owner that the Cottager shall use the Cottage Property and its facilities in accordance with the terms and conditions of this contract. The Cottage Owner together with any other owners of the Cottage Property and their respective assigns, heirs, executors, administrators and other legal representatives shall not be held responsible for any personal injury, sickness, death, loss or damage, however caused, which may be sustained by the Cottager or their family, guests, visitors, servants, agents, pets or any other persons who may be on or about the Cottage Property or who use any utilities, materials or equipment including any and all boats and recreation equipment that may be on or about the Cottage Property. All risks of any such injury or loss shall be the sole responsibility of the Cottager and the Cottager shall indemnify and save the Property Owner together with any other owners of the Cottage Property and their respective assigns, heirs, executors, administrators and other legal representatives harmless from any and all claims made as a result of personal injury, sickness or death, loss or damage, however caused, to the Cottager or their family, guests, visitors, servants, pets, agents or any other persons who may be on or about the Cottage Property at any time. Furthermore, the Cottager accepts full responsibility of the use of any recreational equipment such as boats and motors, etc. and agrees to pay for any repairs or damage to or replacement of said equipment, if caused by the Cottager or any of their family, guests, visitors, servants, agents or any other persons who may use such equipment. For clarification, damage to boats, motors, propellers and canoes CAN exceed the $0 damage deposit and will be the responsibility of the Cottager, payable to owner in full, upon presentation of repair invoice, less any of the damage deposit applied.
Camping: There shall be no camping, tenting, or otherwise placing auxiliary accommodation facilities at the Cottage Property without prior written authorization by the Cottage Owner. The Cottager shall not feed any wild animals and shall make sure to safely store any food and garbage.
Noise: Guests should be mindful of excessive noise between the hours of 10pm and 8am.
Linens: sheets, pillow cases, towels, are not provided at the Cottage Property and the Cottager is responsible for bringing these items.
Included: The cottage property is furnished and includes washer, dryer, music system, fridge, freezer, stove, BBQ and microwave. Please inform owner if you use up a BBQ tank. Empties can be switched out at the marina. Cottage should have 2 propane tanks at all times.
Water and Septic: water is drawn from the lake via a pump. Water is fine for cooking and bathing. Some cottagers also drink lake water…..but cottager may find it more acceptable to bring their own drinking water. Cottage is on a septic system which is very effective BUT it will clog up if improper material is flushed. ONLY flush toilet paper….DO NOT flush feminine products, as they will clog the system and incur repair bills that can be high.
Access: Cottager agrees to allow access to the property by cottage owner for inspection and repair. Cottage owner shall exercise this right of access in a reasonable manner.
If there is a storm or hurricane, no refunds will be given unless: provincial authorities order mandatory evacuation. Power may go out briefly, but Ontario Hydro will restore power generally very quickly.
Owner is not responsible for loss of personal belongings of the guest.
